Carla Foster released after Court of Appeal caves to “cynical” lobbying from abortion industry urging full decriminalisation

A mother, 45, jailed for illegally obtaining abortion drugs to abort her child, Lily, aged 32 to 34 weeks, has been released following an appeal. SPUC has called out the “cynical” abortion industry for using the Carla Foster case to bring about the total decriminalisation of abortion.

Carla Foster, who confessed to the crime, had initially been given a sentence of 28 months in prison. But today the Court of Appeal changed the sentence to 14 months suspended, meaning that she will be released.

Clare Murphy, the chief executive of abortion provider BPAS, said she was “delighted” at the outcome. She also appeared to call for the decriminalisation of abortion, stating: “The court of appeal has today recognised that this cruel, antiquated law does not reflect the values of society today.”

During first sentencing, Justice Pepperall condemned “inappropriate” attempts by the pro-abortion lobby to influence the court. The pro-abortion authors of a letter sent to Justice Pepperell urged the court to pass a non-custodial sentence.

In a damning response, Justice Pepperrell said: “It would plainly not have been appropriate to have allowed any of the authors to address the court. Indeed, I consider that it would have been better if the letter had not been written at all.”

This is what the abortion industry wanted all along

SPUC’s Michael Robinson, Executive Director (Public Affairs and Legal Services), said: “The Court of Appeal has caved in completely to pressure from the abortion industry, chiefly BPAS, and its apologists who are ultimately using this tragic case to bring about the total decriminalisation of abortion.

“After lobbying hard for reckless DIY home abortion, leading to tragic cases such as this – in which the industry then inappropriately attempted to sway the court – the final step now is to remove the rights of unborn babies entirely. This is what the cynical abortion industry wanted all along.

“BPAS never cared about Carla Foster or her baby daughter. Carla and Lily have been used as tools of opportunity to further a pro-abortion agenda. It is as disgusting as it is obvious.

“SPUC calls for justice for baby Lily and urges legislators to hold abortion providers to account and reverse the dangerous home abortion policy that led to this horrifying tragedy. Government must see through the brutal machinations of abortion extremists.”
