Undercover journalist David Daleiden has been fully exonerated after a near decade-long legal battle stemming from his investigation into Planned Parenthood, bringing an end to a case first pursued when Kamala Harris was California Attorney General.
Daleiden, founder of the Center for Medical Progress, confirmed that the final remaining charge against him has now been dismissed and the case expunged, resulting in a “not guilty” outcome with no fines, probation or admission of wrongdoing.
“After enduring 9 years of weaponized political prosecution, putting an end to the lawfare launched by Kamala Harris is a huge victory for my investigative reporting and for the public’s right to know the truth about Planned Parenthood’s sale of aborted baby body parts,” he said.
The case dates back to 2015, when Daleiden and his colleague Sandra Merritt released a series of undercover videos alleging that Planned Parenthood officials were involved in the harvesting and sale of fetal body parts. Rather than prosecuting Planned Parenthood, California authorities launched a criminal investigation into Daleiden himself. Harris authorised a raid on his home in 2016, with the case later pursued by her successor, Xavier Becerra.
Merritt was also prosecuted for her role in the investigation, before eventually walking free after eight years when charges against her were dropped. Daleiden’s exoneration now brings the long-running legal saga to a close.
At the time, Daleiden’s reporting triggered national controversy, with footage appearing to show senior abortion providers discussing fetal tissue procurement. Planned Parenthood repeatedly claimed the videos were “manufactured” and part of a “false smear campaign”, accusations that Daleiden later challenged in court through a defamation lawsuit.
His legal team has argued that it was established in court that the words captured in the recordings “were spoken by those persons”, directly contradicting claims that the footage had been fabricated.
Further material released in subsequent years added to the controversy. Unsealed testimony from Planned Parenthood’s former senior director of medical services, Dr Deborah Nucatola, appeared to confirm under oath that abortion procedures could be altered in order to obtain specific organs.
“If I was aware that it was a donation case, yes,” she said, acknowledging that techniques could be adjusted to avoid damaging particular body parts.
Another senior figure, Dr Mary Gatter, admitted during legal proceedings that her widely reported comment about wanting a “Lamborghini” was directly related to compensation connected with fetal tissue. The remark became one of the most controversial moments of the original footage, cited by critics as emblematic of the issues raised by the investigation.
Daleiden and his supporters have consistently argued that these disclosures demonstrated serious ethical and legal concerns within the abortion industry, and that his work served the public interest.
The decision to prosecute him, rather than the practices he exposed, has been criticised by a number of political figures. Senator Ted Cruz said the case represented “lawfare” used to punish a journalist for exposing wrongdoing, adding that “justice has finally been served”.
Daleiden’s exoneration is likely to reignite debate about both the substance of his original investigation and the actions taken by authorities in response.
While Planned Parenthood has long denied any wrongdoing and maintains that its practices are lawful, the conclusion of the case removes the last remaining criminal charge against the journalist who brought the allegations to public attention.
After nearly ten years of legal battles, the case now ends not with a conviction, but with full dismissal, leaving lingering questions about why the prosecution was pursued in the first place, and what it means for investigative reporting going forward.
